Effective 25 April 2026
These Terms of Service ("Terms") form a binding agreement between you and Bonita Lienkie van der Westhuizen (ABN 66 389 018 686) ("we", "us", "our"). By creating an account or using MusterMate, you agree to these Terms.
If you do not agree to these Terms, do not use the service.
MusterMate is offered on a free tier and on paid annual plans. New accounts receive a 21-day free trial of paid features without requiring a credit card. At the end of the trial, paid features are locked until you choose a plan.
Paid plans are billed annually in advance in Australian dollars via Stripe. Plans renew automatically on the anniversary of your first payment unless you cancel before renewal. Prices are shown on the Settings → Billing page and may be updated from time to time on at least 30 days' notice.
30-day satisfaction guarantee. If you are not completely satisfied within the first 30 days of your initial paid subscription, email hello@mustermate.app and we will refund your annual fee in full — no questions asked. After 30 days, fees for the current billing period are non-refundable except where required by the Australian Consumer Law. Nothing in these Terms limits the guarantees you have under the Australian Consumer Law.
Downgrading. You can downgrade at any time. Your paid features remain active until the end of the current billing period, after which the free tier applies.
You own the farm records you create in MusterMate ("Your Data"). We do not claim any ownership rights in Your Data.
You grant us a limited, non-exclusive licence to host, transmit, back up, and display Your Data solely for the purpose of providing the MusterMate service to you. This licence ends when you delete Your Data or your account.
You can export Your Data as a CSV bundle at any time from Settings → Your data, and can request permanent deletion from Settings → Danger zone.
You agree not to:
We may suspend or terminate accounts that breach these rules.
MusterMate is a record-keeping tool. It is not a substitute for veterinary advice, accounting advice, legal advice, or official regulatory submissions (including but not limited to NLIS transfers via LPA/NLIS databases, APVMA compliance, or biosecurity reporting). You remain solely responsible for:
The MusterMate name, logo, app design, software, and documentation are owned by Bonita Lienkie van der Westhuizen and are protected by copyright and trademark laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the service as described in these Terms. All other rights are reserved.
We aim to keep MusterMate available and working reliably, but we do not guarantee uninterrupted access. We may modify, add, or remove features over time. Material reductions in functionality for paid plans will be notified in advance, and you will be entitled to a pro-rata refund of prepaid fees if you choose not to continue.
To the maximum extent permitted by law, MusterMate is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. All conditions, warranties, guarantees, rights, remedies, liabilities, and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on us are excluded under these Terms.
In relation to any release and/or indemnity given in favour of us, the provisions of Part 4 of the Civil Liability Act 2002 (NSW), Part 9A of the Civil Liability Act 2002 (Tas) and Part 1F of the Civil Liability Act 2002 (WA) do not apply.
Despite the above, nothing contained in these Terms excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other applicable consumer protection legislation. To the extent that such law permits us to limit our liability, our liability is limited, at our option, to re-supplying the service or refunding the fees you paid in the twelve months before the event giving rise to the claim.
Under no circumstances are we liable for indirect, incidental, or consequential loss, including loss of profits, loss of livestock, loss of data that you could have recovered by using the built-in export, or loss arising from your reliance on the service instead of professional advice.
You agree to indemnify us, and hold us harmless, for and against all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, and property loss or damage) incurred or suffered by us arising out of, caused by, attributable to, or resulting from:
To the extent permitted by law, you agree to release us and our current and former officers, employees and agents from all liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses and property loss or damage) which you may incur or suffer arising out of, caused by, attributable to, or resulting from:
You can cancel your subscription or delete your account at any time from Settings.
We may suspend or terminate your account if you materially breach these Terms, if required by law, or if the service is discontinued. Where reasonably possible we will notify you in advance and give you a chance to export Your Data.
We are not responsible for any loss or failure to perform our obligations arising out of any occurrence or condition beyond our reasonable control, including but not limited to any flood, fire, war, terrorism, earthquake, act of god, general strike, pandemic, internet or third-party cloud-provider outage, or any other event outside our control which prevents us from performing our obligations under these Terms.
Any indemnity, release, limitation of liability, or obligation of confidence under these Terms is independent and survives termination of these Terms. Any other term by its nature intended to survive termination survives the termination of these Terms.
If any part of these Terms is found by a court or other competent authority to be illegal or unenforceable, that part will be severed from the remainder of these Terms, which will continue in full force and effect.
A party does not waive a right, power or remedy if it fails to exercise or delays in exercising the right, power or remedy. A waiver of a right, power or remedy must be in writing and signed by the party giving the waiver.
These Terms are governed by the laws of Queensland, Australia. You and we submit to the exclusive jurisdiction of the courts of Queensland and the federal courts of Australia sitting in that state.
We may update these Terms from time to time. For material changes (such as price changes or changes that reduce your rights), we will give you at least 30 days' notice by email and/or via an in-app banner. Continued use of the service after the change takes effect constitutes acceptance of the updated Terms.
